By filling out and submitting this form, the CLIENT to all the terms and conditions of this agreement

This is an agreement contract between the above referenced Client Name, known for the purposes of this Agreement as CLIENT, and Ally Berry Photography, known for the purposes of this Agreement as the PHOTOGRAPHER. the CLIENT and the PHOTOGRAPHER agree to the following:

Services

The PHOTOGRAPHER agrees to reserve the scheduled date, time and location to provide the CLIENT with a photo session, as agreed between the two parties.

Both parties agree to cooperate and communicate in the best way to achieve the best results. The PHOTOGRAPHER will not be held responsible if key fail to appear or cooperate during the photo session, or for missed images due to information not provided to the PHOTOGRAPHER.

The CLIENT confirms that he has authority to give consent on behalf of all the people being photographed during the photo session.

The PHOTOGRAPHER will take images of the CLIENT during the booked photo session. The PHOTOGRAPHER will then provide the client with high resolution web-ready digital images within 21 days of the photo session. The minimum number of images will be agreed in advance between the PHOTOGRAPHER and the CLIENT and will depend on the type and length of photo session booked.

Copyright

The CLIENT understands and agrees that the PHOTOGRAPHER owns the copyright and reserves all rights to all the images taken during the photo session.

The PHOTOGRAPHER will grant the CLIENT usage rights for the photographs provided. This includes posting the photographs on the client’s website, and use for social media and publications. The CLIENT may not edit (with the exception of cropping) or sell the photographs to any third party.

Payment

The CLIENT agrees to pay a £50 non-refundable deposit upon confirming the photo session.

The CLIENT also agrees to pay the remaining balance for the session within 7 days of the receipt of the invoice from the PHOTOGRAPHER, and no later than 21 days after the date of the photo session.

Rescheduling and cancellation

In the unlikely event that the CLIENT has to reschedule the photo session, the PHOTOGRAPHER will do their best to find a new mutually suitable time and date, within 6 months of the original photo session date. If the CLIENT and the PHOTOGRAPHER are unable to agree to a new date, then the photo session will be cancelled, and no refund will be given. The PHOTOGRAPHER will not be held responsible for any missed images resulting from having to reschedule the session at the CLIENT’s request.

In the unlikely event that the PHOTOGRAPHER has to reschedule a photo session, the CLIENT may reschedule the session within 6 months of the original photo session date, or cancel the agreement. In the photo session is cancelled due to the PHOTOGRAPHER being unable to provide the services agreed and a new time and date cannot be agreed, the full deposit will be refunded to the CLIENT.

Limit of liability

The services provided by the PHOTOGRAPHER are not refundable.

If for any reason the CLIENT is not entirely satisfied, they should communicate this to the PHOTOGRAPHER immediately, so that the matter can be resolved. Re-shoots will be done at the sole discretion of the photographer.

In the unlikely event of photographs being lost, stolen or destroyed for reasons beyond the PHOTOGRAPHER’s control, the PHOTOGRAPHER’s liability will be limited to scheduling a new photo session to complete the services paid for. The PHOTOGRAPHER is not responsible for refunding any fees or any expenses paid by the CLIENT to any third party.
